These Terms and Conditions govern your use of the Lingocaf language-learning platform operated by Lingocaf Pty Ltd, an Australian company. By using Lingocaf, you agree to these Terms. These Terms include important provisions about refunds, limitation of liability, and dispute resolution.
1. Acceptance of Terms
By creating an account, accessing, or using the Lingocaf platform (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you must not use the Service.
These Terms constitute a legally binding agreement between you and Lingocaf Pty Ltd ABN [ABN NUMBER] ("Lingocaf", "we", "us", or "our"), a company incorporated in Australia.
If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms, and "you" refers to both you and the organisation.
2. Description of Service
Lingocaf is a language-learning platform that offers AI-generated and curated stories, audio narration, vocabulary tools, comprehension challenges, and AI-powered tutoring across multiple languages at various CEFR proficiency levels.
The Service includes:
• Curated curriculum story paths graded to your CEFR level
• Native-quality audio with word-by-word synchronisation
• Comprehension challenges and vocabulary exercises
• AI tutor conversations tied to story content
• Personalised stories generated based on your interests upon curriculum completion
• Virtual café social reading rooms
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice where possible.
3. Account Registration and Security
To access most features, you must register for an account. You agree to:
• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and not share it with others
• Notify us immediately at legal@lingocaf.com of any unauthorised access to your account
• Accept responsibility for all activity occurring under your account
You may not create an account using a false identity or impersonate another person. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Eligibility and Age Requirements
You must be at least 13 years of age to use Lingocaf. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information without parental consent, we will take steps to delete that information.

5. Subscriptions and Payment
Lingocaf offers both free and paid subscription tiers. Paid subscriptions ("Premium") unlock additional features including unlimited story generation, advanced vocabulary tools, and priority AI tutor access.
Billing and charges:
• Subscription fees are charged in advance on a monthly or annual basis
• All prices are displayed in Australian Dollars (AUD) unless otherwise stated
• Prices are inclusive of any applicable Australian Goods and Services Tax (GST)
• Payment is processed via our third-party payment processor (Stripe)
• By providing payment details, you authorise us to charge you the applicable subscription fee on a recurring basis
Price changes:
• We may change subscription prices with at least 30 days' written notice
• Your continued use of a paid subscription after the notice period constitutes acceptance of the new pricing
• Annual subscribers will not have their price changed mid-subscription period
6. Free Trial
We may offer a free trial of Premium features for new subscribers. Free trial terms:
• The trial period and features available will be specified at the time of sign-up
• A valid payment method may be required to start a free trial
• You will be automatically charged the applicable subscription fee at the end of the trial unless you cancel before the trial ends
• We reserve the right to modify or cancel free trial offers at any time
• Only one free trial per person or household; creating multiple accounts to obtain multiple free trials is prohibited
7. Cancellation and Refunds
Cancellation:
You may cancel your subscription at any time through your account settings or by contacting us at legal@lingocaf.com. Cancellation takes effect at the end of the current billing period; you retain access to Premium features until that date.
Refunds:
We offer refunds in the following circumstances:
• If you cancel within 14 days of your initial subscription purchase and have not made substantial use of the Premium features ("cooling-off period")
• If there is a significant failure of the Service that we are unable to remedy within a reasonable timeframe
Refunds are not ordinarily provided for:
• Partial months of service after cancellation mid-period
• Forgetting to cancel a subscription before renewal
• Dissatisfaction with AI-generated story content (which is inherently variable)
Australian Consumer Law:
Nothing in these Terms limits or excludes your rights under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). Where the Australian Consumer Law implies a guarantee that cannot be excluded, our liability for a failure to comply with that guarantee is limited, to the extent permitted by law, to resupplying the Service or paying the cost of having the Service resupplied.

8. User Content
You may submit content to Lingocaf, including responses to AI tutors, forum or café posts, and feedback ("User Content"). By submitting User Content, you:
• Represent that you own or have the necessary rights to submit the content
• Grant Lingocaf a non-exclusive, worldwide, royalty-free licence to use, store, display, and process your User Content solely for the purpose of operating and improving the Service
• Acknowledge that User Content may be reviewed for safety, quality, and moderation purposes
Prohibited User Content:
You must not submit content that is unlawful, defamatory, threatening, obscene, discriminatory, hateful, sexually explicit, or that infringes any third-party intellectual property rights.
We reserve the right to remove any User Content that violates these Terms without notice.
9. AI-Generated Content
The Service uses artificial intelligence to generate stories, audio narrations, tutor responses, and vocabulary content. Regarding AI-generated content:
• Stories, translations, and tutor responses are AI-generated and may contain errors, inaccuracies, or culturally imprecise content
• AI-generated content is not a substitute for professional language instruction, certified translation, or cultural guidance
• We do not guarantee the linguistic accuracy, grammatical correctness, or cultural appropriateness of AI-generated content
• AI tutors are not certified language teachers and their responses should not be relied upon for formal academic, professional, or legal purposes
You use AI-generated content at your own discretion. We continually improve our AI systems, and content quality may vary between sessions.
10. Intellectual Property
Our intellectual property:
All content on Lingocaf — including the software, platform design, curated stories, audio recordings, illustrations, trademarks (including the Lingocaf name and logo), and AI systems — is owned by or licenced to Lingocaf Pty Ltd and is protected by Australian and international copyright, trademark, and other intellectual property laws.
Your licence:
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial language-learning purposes, subject to these Terms.
Restrictions:
You must not:
• Copy, reproduce, modify, or distribute any part of the Service without our written consent
• Reverse-engineer, decompile, or attempt to extract source code from the platform
• Use automated tools (bots, scrapers, crawlers) to access or extract content from the Service
• Resell or commercialise any content obtained from the Service
• Remove any copyright or proprietary notices from content
11. Prohibited Conduct
When using Lingocaf, you must not:
• Violate any applicable Australian federal, state, or territory law, or any other applicable law
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Upload, transmit, or distribute malware, viruses, or any other harmful code
• Attempt to gain unauthorised access to any part of the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Engage in any form of harassment, bullying, or abusive behaviour toward other users
• Create multiple accounts to circumvent restrictions or bans
• Use the Service for commercial purposes, including selling or advertising products or services, without our prior written consent
• Engage in academic dishonesty (e.g., misrepresenting AI-generated responses as your own in formal assessments)
Violation of these prohibitions may result in immediate suspension or termination of your account.
12. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, store, and disclose personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
By using Lingocaf, you consent to the collection and use of your information as described in our Privacy Policy.
Key points:
• We collect information you provide (name, email, learning preferences) and usage data (stories read, words learned, session activity)
• We use this information to operate the Service, personalise your learning experience, and improve our AI systems
• We do not sell your personal information to third parties
• Data may be stored on servers located outside Australia; where this occurs, we take steps to ensure comparable privacy protections apply

13. Communications
By creating an account, you consent to receive:
• Transactional communications (account confirmations, billing receipts, security alerts) — these are necessary for the Service and cannot be opted out of
• Product updates and learning tips — you may unsubscribe at any time via the unsubscribe link in any email or through your account settings
We comply with the Spam Act 2003 (Cth). We will not send you unsolicited commercial electronic messages without your consent.
14. Disclaimers
To the maximum extent permitted by Australian law:
• The Service is provided "as is" and "as available" without warranties of any kind, either express or implied
• We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components
• We do not warrant that using Lingocaf will result in any particular language proficiency outcome
• AI-generated content is provided for entertainment and educational enrichment purposes; we make no representations about its accuracy or fitness for any particular purpose
Nothing in this clause limits your rights under the Australian Consumer Law.
15. Limitation of Liability
To the fullest extent permitted by law (including the Australian Consumer Law):
• Lingocaf's total aggregate liability to you for any claim arising under or in connection with these Terms or the Service will not exceed the greater of: (a) the total subscription fees you paid to us in the 12 months preceding the claim, or (b) AUD $100
• We will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, even if advised of the possibility of such damages
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
16. Third-Party Services
The Service integrates with third-party services, including payment processors (Stripe), authentication providers, cloud infrastructure, and AI model providers. These third-party services have their own terms and privacy policies, and we are not responsible for their practices.
Any links to third-party websites are provided for convenience only; we do not endorse or accept responsibility for any content, advertising, or services on those sites.
17. Termination
By you:
You may close your account at any time by visiting account settings or emailing legal@lingocaf.com. Upon closure, your access to the Service will cease and your data will be handled in accordance with our Privacy Policy.
By us:
We reserve the right to suspend or terminate your account immediately, without prior notice, if we reasonably believe you have:
• Violated these Terms
• Engaged in fraudulent, abusive, or illegal conduct
• Created a risk of harm to us, other users, or third parties
Where we terminate your account without cause, we will provide a pro-rata refund of any prepaid subscription fees.
18. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will:
• Post the updated Terms on this page with a revised "Last updated" date
• Notify you by email or via an in-app notification at least 14 days before the changes take effect
Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may cancel your subscription before the changes take effect.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of New South Wales, Australia, and the Commonwealth of Australia, without regard to conflict-of-law principles.
Dispute resolution:
Before commencing formal proceedings, you agree to contact us at legal@lingocaf.com to attempt to resolve any dispute informally. We will try to resolve your concern within 30 days.
If a dispute cannot be resolved informally:
• Either party may refer the matter to mediation through the Australian Disputes Centre
• If mediation fails, disputes will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia
Nothing in this clause limits your right to make a complaint to the Australian Competition and Consumer Commission (ACCC), the Office of the Australian Information Commissioner (OAIC), or your state or territory's consumer protection body.
20. General Provisions
Entire agreement: These Terms (together with our Privacy Policy) constitute the entire agreement between you and Lingocaf regarding the Service and supersede all prior agreements.
Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.
Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms to a successor in connection with a merger, acquisition, or sale of assets.
Force majeure: We will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, internet outages, or third-party service failures.
